Waiver of Liability for Obvious Risks
By booking The Woll on Kerripit the guests acknowledge and agree as follows:
1. **Acknowledgment of Risks**: The guests acknowledge that staying at a farm involves certain obvious risks, including but not limited to interactions with animals, the use of farming equipment, uneven terrain, exposure to weather conditions, and participation in farm activities.
2. **Assumption of Risk**: The guests voluntarily assume all risks associated with staying at the farm, including the risks of injury, loss, or damage arising from, but limited to, the aforementioned activities and conditions. The guests acknowledge that these risks are inherent in farm life and cannot be completely eliminated.
3. **Waiver and Release**: To the fullest extent permitted by law, the guests release and forever discharges the farm owner, its employees, agents, and representatives from any and all claims, demands, actions, or causes of action arising from or in connection with the undersigned's stay at the farm, including but not limited to claims arising from the negligence of the farm owner or its employees.
4. **Indemnification**: The guests agree to indemnify and hold harmless the farm owner from any and all claims, demands, actions, or causes of action brought against the farm owner by any third party as a result of the guests' actions or omissions while staying at the farm.
5. **Governing Law**: This waiver and release shall be governed by and construed in accordance with the laws of New South Wales, including the Civil Liability Act of NSW.
By booking, the guests acknowledge that they have read and understood this waiver and release, and agree to be bound by its terms.
